WellSpan York Hospital is warning patients who had open-heart surgery at the hospital over a three-and-a-half-year period that they may have been exposed to a dangerous bacteria. The source of the infection is thought to be the hospital’s “heater-cooler devices,” which are used to warm and cool a patient’s blood during cardiopulmonary bypass. The Pennsylvania Department of Health said on Monday that a recent investigation found a “cluster of Nontuberculous Mycobacterium (NTM) infections involving patients who had open heart surgeries requiring cardiopulmonary bypass at WellSpan York Hospital.”

When such deviations leads to a serious injury, the medical professional may be held liable for the damages you have suffered. Every medical professional has a duty to treat patients in such a way as to minimize potential for further injury. Medical malpractice lawsuits are designed to give patients who have been injured by a negligent professional a way to recover monetary compensation to make up for their injury or damages.

Standards of Care

Medical professionals are required to have medical knowledge, requisite skills to apply the knowledge, exercise a level of care that is standard in their medical profession and use of medical judgment that conforms medically acceptable standard of care. A professional breaches that duty of care if he fails to meet the medically accepted standard of care and may be held liable for medical negligence.

Medical Negligence

Medical negligence is a term used to describe mistakes made or lack of proper care delivered by a doctor, nurse or medical staff member. Those persons should have had training and knowledge to safely administer correct prescriptions and carry out medical procedures in a safe and accurate manner. Their inability to do so may be considered medical negligence.

What are some examples of Negligence?

There are many forms of Medical negligence. It can originate in wrong diagnosis, improper treatment or surgical errors. With improper treatment or a premature discharge or improper testing or failure to recognize symptoms, not only is the medical issue (that was the reason for going to the professional for help) not treated but also the improper treatment may have led to additional extremely negative and harmful consequences or side effects and could even be fatal. If there is a wrong diagnosis or a failure to diagnose the problem, the patient cannot make the decisions needed to obtain the correct treatment and the delay in finding the correct diagnosis may have irreversible consequences and may change any future treatment options.

Where does Medical Negligence stem from?

There can be misreading or failure to accurately read the laboratory results which will lead to improper conclusions. There may be improper medication or dosage or disregard for patient’s history or failure to accurately read patient’s chart. Surgical errors can result in life changing events for the patient and his family. Surgical errors are generally a result of medical negligence. These errors include wrong site surgery, anesthesia type or amount errors, wrong type of surgery to wrong patient, incorrect surgical procedures, foreign objects left inside the body and improper closure leading to infections and other complications.
